§ 175 Penal Code

The sodomy , which is celebrated between persons of male sex or by humans with animals is punishable by prison and may also be recognized on loss of civil rights.

§ 175 StGB

( 1) A man who drives with another man fornication or lets himself be abused for a sex offense , shall be punished by imprisonment.

( 2) If a party who was not yet twenty-one time of the offense , the court may waive particularly in mild cases of punishment.

 § 175 a StGB

With imprisonment up to ten years , with mitigating circumstances with imprisonment not less than three months shall be punished :

   1. a man who compels another man by force or by threat of imminent danger to life or limb to drive with him fornication or to let himself be abused for a sex offense ;

   2. a man who designate another man abusing a reasoned by a service , labor or subordination dependency to drive with him fornication or to let himself be abused for a sex offense ;

   3. a man over twenty-one years who seduces a male person under twenty-one years , to drive with him fornication or to let himself be abused for a sex offense ;

   4. a man who drives a commercial basis with men fornication or of men can be abused for a sex offense or offers to do so.

§ 175 StGB: Homosexual acts

 (1 ) A prison sentence of up to five years shall be imposed

   1. man over eighteen years of driving with a plastic col man under twenty-one years of fornication or lets himself be abused by him for fornication,

   2. a man who designate another man abusing a reasoned by a service , labor or subordination dependency to drive with him fornication or to let himself be abused for a sex offense ,

   3. a man who drives a commercial basis with men fornication or of men can be abused for a sex offense or offers to do so.

 ( 2) In the cases of paragraph 1 No. 2 of the attempt is punishable.

 ( 3) If a party who was not yet twenty-one time of the offense , the court may waive the penalty.

 § 175b is repealed.

§ 175 StGB: Homosexual acts

 (1 ) A man over the age of eighteen who performs sexual acts on a man under 18 or can be performed by a man under the age of 18 will be punished with imprisonment up to five years or a fine.

 ( 2) The court may dispense with punishment pursuant to this provision , if

   1. the offender at the time the act was not yet twenty-one or

   2. of that in mind the behavior against which the act is directed , that is low injustice indeed.
